After worrying for the past several years that toxic mold might be the next asbestos, apartment owners can breathe easier after the U.S. District Court for Arizona delivered an owner-friendly verdict in Kilian v. Equity Residential Trust, a mold-related lawsuit.

The plaintiff claimed that after being exposed to mold in her apartment, she developed a brain injury, seizures, a movement disorder, a neurocognitive disorder and an immune system disorder. She sued Equity Residential, the apartment owner, for personal injury.
