David and Jessica Mireles filed a lawsuit on May 5 in the Harris County District Court against Pioneer Homes alleging negligence, violations of the Deceptive Trade Practices Act, breach of implied warranty and breach of contract.
The Mireles family says that on Sept. 2, 2010, a mold infestation forced them to move out of their Pioneer-built home, located at Mainstay Place in Lake Houston. According to the brief, a subcontractor, hired by Pioneer Homes, drove a nail into a plumbing pipe, which caused a leak.
