A judge last week upheld the eviction of an Ojo Caliente couple who say they were sickened by a toxic mold infestation in their Rio Arriba County public housing unit.
State District Court Judge James Hall ruled Dec. 30 in Santa Fe in favor of the County Housing Authority, which began eviction proceedings in April against James McConnell and Suzanne Tattan.
The Authority first cited a lease violation having to do with a car parked in the unit’s backyard for evicting the couple from the Ojo Caliente low-income housing development. But since then Authority employees have felt threatened by McConnell, County attorney Adán Trujillo told Hall in court.
